Many people are confused about the specific nature of their Washington traffic ticket, and whether it constitutes a crime.  Basically, there are two types of traffic violations a person can be cited for, a traffic infraction or a traffic crime.

Common traffic infractions include failure to signal, running a red light, or speeding.  All traffic infractions are a civil offense for which the penalty is a fine, but no jail time is ever required because it's not a crime.

 

Traffic crimes are more serious and often incur mandatory fines, penalties, and jail time.  Common traffic crimes include negligent driving, hit and run, driving under the influence, and reckless driving.  All are considered a type of misdemeanor criminal offense and should be taken very seriously.

 

We are well versed in both areas of traffic law, and we always provide our clients with an aggressive defense, whether they are charged with a traffic crime or a traffic violation. 

 

It is important to realize that if you have been issued a non-criminal traffic infraction, then failure to properly respond and deal with the infraction can lead to a criminal charge at a later date.  For instance, if you have been issued a Washington traffic ticket and you choose to ignore it, then the matter defaults and the infraction will be deemed to have been committed.  

If you do not pay the fine and refuse to resolve the matter, your license will be suspended.  Then, if you are stopped for another traffic infraction, you could be arrested and charged with a criminal misdemeanor.  Conviction could result in being sentence to 90 days in jail and a $1000 fine.

 

This means that ever must be addressed, taken seriously, and resolved no matter what the circumstances.  Having an attorney act as your legal advocate is usually your best option.

 

You can also have your license suspended if you are ticketed for six moving violations in any 12 month period.  The suspension will last for 60 days, and there will be no probation following the suspension.

Sometimes, too many traffic violations can lead to being put on probation for a period of one year.  This means that your license is in a conditional status, and if you receive additional tickets during that year, your license will be suspended.  Other situations can arise that will result in a license suspension if you receive too many tickets over a given period of time.

The seriousness of this cannot be overstated.  To get your license back after a suspension of any length requires that you provide proof of high-risk auto insurance (SR-22), and you will be required to pay a $75 re-issue fee the next time you apply for your license.  With so much at stake, it is obvious why fighting for your rights after every single traffic infraction is so important.

What exactly is a Washington State Traffic ticket?

We are often asked about the specific definition of a traffic ticket.  Here's what you need to understand.  In the not so distant past, many traffic and minor conduct-related matters were simply charged as crimes.  Over the years, however, our legislature in Olympia saw fit to decriminalized many of these offenses. 

In the vast majority of cases, these types of decriminalized matters are related to driving, vehicles, traffic, parks, wildlife, and fisheries offenses.  Following the reclassification of these offenses, they are now legally known as infractions and are civil cases. 

The critical distinction between infractions and crimes is that infractions do not subject an alleged violator to any potential jail time.  Instead, the maximum penalty is a fine.  In most instances, however, it is important to know that a failure to properly respond and deal with a traffic infraction can lead to a criminal charge down the road. 

For example, if you have been issued a speeding ticket and choose to completely ignore it, then the matter will be defaulted and the infraction will be deemed to have been committed.  If you do not promptly pay the fine, the matter will eventually be sent to collections.

The Washington State Department of Licensing will also be notified.  Once the WA Department of Licensing is notified, they will suspend your Washington State driver's license if you continue to do nothing to resolve the matter. 

If you are then later stopped for another traffic infraction, you can be arrested and charged with Driving While License Suspended in the Third Degree (DWLS 3rd Degree), which is a criminal misdemeanor. 

If you are later convicted of DWLS 3rd Degree, you could be sentenced up to 90 days in jail.  You are also subject to a $1,000 fine.  It is therefore critical to deal with all driving-related infractions in a prompt and responsible manner.
